About The Position

The Assistant District Attorney evaluates criminal cases that come into the office and represents the state in the resolution of the case via dismissal, plea negotiations, or trial. The position involves drafting accusations and indictments, evaluating and researching potential defenses, and dismissing cases not prosecutable. The Assistant District Attorney reads cases submitted by investigators, determines whether further investigation is needed, and researches alternative crimes and case law. They present cases to the grand jury, question witnesses, and determine appropriate sentence recommendations. The role also includes negotiating pleas, interviewing witnesses, developing trial strategies, and representing the state in probation revocation hearings.

Requirements

• Juris Doctorate.
• Three (3) years previous experience and/or training that includes litigation and criminal law experience.
• Valid membership in the Georgia Bar Association, Court of Appeals of the State of Georgia, and Supreme Court of the State of Georgia.

Responsibilities

• Drafts accusations and indictments; evaluates and researches potential defenses; dismisses cases not prosecutable.
• Reads cases submitted by investigator; reads police reports; determines whether further investigation is needed; approves or returns cases for more work; researches alternative crimes; reads and researches case law.
• Presents cases to grand jury; questions witnesses; answers jurors questions; determines appropriate sentence recommendations; calls arraignment calendars; attends pre-trial conferences with judge and defense attorneys.
• Subpoenas appropriate witnesses for motions; researches and argues all pretrial and post trial motions; files motions in appropriate time frame prior to trial.
• Complies with discovery requirements by copying and mailing documents.
• Works with trial team investigators to coordinate witnesses and evidence for trials; gathers and labels evidence.
• Negotiates pleas to dispose of cases.
• Interviews witnesses, victims, experts, and the police; questions potential jurors and selects jury; arranges interpreter services for witnesses when necessary.
• Develops trial strategy for each case; organizes opening and closing arguments; presents evidence at trial; consults with supervisors about trial strategy.
• Fills out jury cards; reads appellate briefs and case transcripts; researches and writes responses to briefs.
• Represents state in probation revocation hearings; responds to parole notices.
• Handles telephone calls from attorneys, witnesses, and concerned citizens.
• Determines appropriate bond amounts.
• Attends meetings; maintains continuing education requirements.
• Speaks to reporters on various cases.
• Supervises, directs, and evaluates assigned staff, processing employee concerns and problems, directing work, counseling, and completing employee performance appraisals.
