About the position

The Privacy Attorney or Privacy Counsel role at The Kroger Co. involves providing legal review, guidance, and support on privacy, data protection, and security matters across the organization and its affiliated companies. This position is crucial in partnering cross-functionally with various business units, including IT, sourcing, product development, engineering, and information security, as well as collaborating with other attorneys within the company. The primary goal is to inform, influence, and advise on data uses and privacy strategies while managing legal risks and ensuring compliance with regulatory requirements regarding the use of personal information. In this role, the attorney will be responsible for drafting, reviewing, and negotiating data protection addendums and other data-related agreements that support a wide range of business initiatives. This includes working with vendors, clients, and business partners to negotiate complex commercial transactions involving consumer data, such as technology, marketing, and licensing agreements. The attorney will also provide pragmatic privacy and data security subject matter expertise, offering guidance on compliance with all applicable laws, rules, and regulations. Additionally, the Privacy Counsel will partner with the Privacy Office to support and enhance Kroger's existing privacy program, which includes privacy operations, documentation, employee training, policy enforcement, and monitoring and auditing. The role requires proactive monitoring of relevant consumer protection, privacy, and data security laws and regulations, as well as staying updated on enforcement actions, technological developments, and evolving industry standards and best practices. The candidate must be able to perform the essential job functions of this position with or without reasonable accommodation.

Responsibilities

  • Draft, review and negotiate data protection addendums and other data-related agreements for wide-ranging business initiatives, including with vendors, clients, and business partners.
  • Negotiate a wide range of complex commercial transactions involving consumer data, including technology, marketing, and license agreements.
  • Provide pragmatic privacy and data security subject matter expertise, guidance and advise on compliance with all applicable laws, rules and regulations.
  • Partner with our Privacy Office to support, enhance, scale and run Kroger's existing privacy program, including privacy operations and documentation; employee training; policy enforcement, and monitoring and auditing.
  • Collaborate with compliance, information security and other stakeholders to perform privacy assessments.
  • Proactively monitor and remain up to date on relevant consumer protection, privacy and data security laws and regulations, enforcement actions, technological developments, threat vectors, industry and regulatory trends and topics, and evolving industry standards and best practices.

Requirements

  • Extensive experience with consumer data privacy and security law (2+ years of experience providing pragmatic and actionable advice to clients on various legal risks and obligations under privacy and data security laws in the U.S.)
  • Desire to do and experience with doing the hands-on work of reviewing, drafting, and negotiating documents and contracts (in addition to advising, leading, counseling the business)
  • 4+ years combined experience in law firms, governmental agencies, and/or in-house legal departments
  • Juris Doctor from accredited U.S. law school
  • Admission to at least one state bar
  • Experience drafting and negotiating data privacy and security terms and agreements, with retail media and advertising experience strongly preferred
  • Knowledge and understanding of data privacy and security laws, regulations and industry best practices, with expertise on how those laws apply in the digital media and advertising space strongly preferred
  • Bachelor's Degree in IT, Data Analytics or Cybersecurity
  • Preference for candidates that started their career with a firm prior to going in-house/corporate
