About the position

Our customer, a leading multinational technology company, is seeking a Data Privacy and Security Counsel professional with expertise in data privacy, cybersecurity, and emerging technologies, particularly artificial intelligence (AI). The selected attorney will provide counsel to ensure compliance with data privacy regulations, cybersecurity best practices, and legal assessments related to AI systems. They also require expertise in drafting and reviewing data privacy addendums and conducting AI risk assessments. The selected attorney will work closely and cross-functionally with engineers, government relations and policy experts, finance and accounting professionals, sales and marketing professionals, communications experts, and other attorneys. These are important matters, and this person can expect to have exposure to senior executives of the company. Candidates will need to be great writers, communicators, and presenters.

Responsibilities

  • Ensuring adherence to relevant data privacy regulations (e.g., GDPR, CCPA, HIPAA) and staying informed about new and evolving regulations affecting data protection and AI.
  • Providing legal advice on cybersecurity frameworks, breach response plans, and risk mitigation strategies.
  • Offering legal counsel in the event of a data breach, including regulatory reporting, breach notification, and legal representation.
  • Drafting and reviewing data processing agreements (DPAs), privacy policies, and other legal documents to ensure compliance with global privacy standards.
  • Assessing the legal risks of AI systems, ensuring responsible AI use, managing issues related to bias, explainability, and accountability, and ensuring compliance with regulations such as the EU AI Act or other relevant laws.
  • Providing legal advice on establishing and maintaining ethical AI governance structures and compliance with internal and external AI guidelines.
  • Offering legal guidance on developing training programs for employees on data privacy, cybersecurity policies, AI ethics, and compliance.
  • Ensuring that vendors and partners are compliant with data privacy regulations and AI governance policies through audits and contractual agreements.

Requirements

  • JD or equivalent degree.
  • Minimum 5 years of experience in Data Privacy, Cybersecurity and AI.
  • Active member of the State Bar (where you are located) in good standing.
  • Excellent written and verbal communication skills.
  • Strong presentation skills and comfort working with senior executives.
