About the position

The Administrative Law Judge/Assistant Administrative Law Judge position within the New York Department of Motor Vehicles involves conducting administrative hearings and making legal decisions regarding traffic violations and related cases. This role is part of the NY HELPS program, which allows for non-competitive appointments, and aims to ensure fair adjudication of motor vehicle laws and regulations. The position requires a strong legal background and offers opportunities for professional growth within public service.

Responsibilities

  • Conduct administrative hearings for adjudication of moving traffic violations.
  • Render decisions on cases involving fatal accidents and persistent violators.
  • Handle violations related to the Vehicle and Traffic Law and the Commissioner's Rules and Regulations.
  • Prepare cases for review by the Motor Vehicle's Appeals Board.
  • Make decisions on violations of the Navigation Law and Parks, Recreation and Historic Preservation Laws.
  • Influence decisions based on the Zero Tolerance Program and emission inspection regulations.

Requirements

  • Admission to the NYS bar and two years of post-licensure professional legal experience for Administrative Law Judge.
  • 12 months as an Assistant Attorney 2 or admission to the NYS Bar with 12 months of satisfactory legal experience for Assistant Administrative Law Judge.
  • One year of permanent service in a Grade 21 or higher title for transfer eligibility.
