About the position

The Administrative Law Judge/Assistant Administrative Law Judge position within the NY HELPS program involves conducting administrative hearings and making legal decisions regarding traffic violations and related cases. This role is crucial for ensuring compliance with New York's Vehicle and Traffic Laws, as well as other relevant regulations. The position is permanent and full-time, requiring a strong legal background and the ability to handle complex legal matters in a public service context.

Responsibilities

  • Conduct administrative hearings for adjudicating moving traffic violations and related cases.
  • Render decisions on violations of the Vehicle and Traffic Law and the Commissioner's Rules and Regulations.
  • Prepare cases for review by the Motor Vehicle's Appeals Board.
  • Adjudicate cases involving fatal accidents and persistent violators.
  • Evaluate charges against commercial establishments such as repair shops and driving schools.
  • Make decisions influenced by the Zero Tolerance Program and emission inspection regulations.

Requirements

  • Admission to the NYS bar and two years of post-licensure professional legal experience for Administrative Law Judge.
  • 12 months as an Assistant Attorney 2 or admission to the NYS Bar with 12 months of satisfactory legal experience for Assistant Administrative Law Judge.
  • One year of permanent, contingent-permanent, or 55 B/C service allocated to a Grade 21 or higher for transfer eligibility.

Nice-to-haves

  • At least three years' experience as a New York State Attorney.
  • Strong research and writing skills.
  • Demonstrated sound judgment and excellent oral communication skills.
