Appeals Referee

About the position

The Appeals Referee position at the North Carolina Department of Commerce is responsible for presiding over quasi-judicial evidentiary hearings related to contested unemployment insurance claims. This role involves conducting hearings, applying relevant laws and regulations, and delivering final agency decisions on appeals. The Appeals Referee must ensure a fair hearing process for all parties involved and provide knowledgeable customer service throughout the proceedings.

Responsibilities

• Schedule and conduct hearings regarding appeals of adjudicated Unemployment Insurance claims.
• Preside over quasi-judicial evidentiary hearings on contested claims for UI benefits and UI fraud.
• Render decisions that are final agency decisions, subject to further appeal.
• Apply Division of Employment Security (DES) law, rules, and applicable case law in drafting orders and decisions.
• Respond to and rule on preliminary motions in accordance with DES rules and applicable case law.
• Provide accurate information about DES appeals law, rules, policy, and procedure.
• Maintain a courteous and professional demeanor under pressure.

Requirements

• Juris Doctor from an appropriately accredited institution.
• Active license to practice law in North Carolina.
• Basic knowledge of the principles and practices of administrative law.
• Ability to interpret laws, rules, regulations, and court decisions.
• Ability to analyze facts, evidence, and legal documents.
• Ability to express legal interpretations or conclusions clearly and logically in oral and written form.
• Ability to maintain effective working relationships with the public and other persons contacted in the course of work.
