About the position

The Assistant Commonwealth's Attorney is responsible for prosecuting criminal cases on behalf of the Commonwealth of Virginia. This role involves conducting legal research, preparing and presenting cases in court, and providing legal advice to various stakeholders including public officials and law enforcement. The position requires a high level of initiative and independent judgment in handling a variety of legal situations, while maintaining professionalism and discretion in interactions with victims, suspects, and the public.

Responsibilities

  • Prepare misdemeanor and felony criminal cases for trial, including interviewing witnesses and negotiating with defense attorneys.
  • Present cases in court, making motions and recommendations, and questioning witnesses and defendants.
  • Perform case management functions such as screening cases for prosecution and preparing case documents.
  • Conduct legal research and prepare memorandums of law for assigned criminal cases.
  • Provide legal advice and counsel to public officials and law enforcement, and inform them of new rulings.
  • Prepare legal briefs and agreements for presentation to the Appellate Court as necessary.
  • Assist victims of crime in seeking compensation and inform them of available services.
  • Stay updated on legal developments by studying legal periodicals and attending courses for continuing education.
  • Lecture at local law enforcement academies and legal conferences, and make presentations to schools and civic groups.

Requirements

  • Juris Doctorate Degree and 1 to 5 years of experience in criminal law, including courtroom trial experience.
  • Knowledge of criminal law proceedings, practices, policies, and regulations.
  • Ability to perform comprehensive legal research and understand judicial procedures and rules of evidence.
  • Skill in legal writing and oratory, with the ability to effectively interview various stakeholders.
  • Familiarity with common office software such as Microsoft Office, Adobe, and Westlaw.

Nice-to-haves

  • Experience in negotiating settlements or plea bargains.
  • Familiarity with the National Crime Information Center computer system.
  • Ability to communicate professionally and respectfully under stress.
