About the position

The Associate General Counsel - Litigation Management & Malpractice at NYU Langone Health is responsible for providing proactive legal advice and managing medical malpractice cases and claims. This role involves direct management of claim files, coordination with outside counsel, and strategic negotiation to optimize claim handling and results. The position requires significant experience in medical malpractice law and effective communication skills to work with diverse personnel.

Responsibilities

  • Provide competent, timely, and proactive legal advice in the management of medical malpractice cases and claims.
  • Manage and direct the day-to-day activities of assigned claim files and outside counsel.
  • Proactively coordinate reasonable and strategic defenses to optimize claim handling and results.
  • Assume primary responsibility for the legal management and resolution of approximately 100 high-value claims in various jurisdictions.
  • Assist in the choice of counsel and manage litigation costs and expenses.
  • Keep senior counsel informed of material changes and updates in litigation status.
  • Initiate early strategic resolution of claims where possible and actively negotiate cases directly with adversaries.
  • Stay updated on changes in law and legal climate, providing legal analysis on coverage issues.
  • Provide day-to-day strategic planning on claims handling and respond to time-sensitive projects.
  • Attend and travel to all phases of court conferences as needed, managing preparation of key defendants for depositions and trial.
  • Monitor all phases of trial and report daily progress, modifying strategies as necessary.
  • Participate in claims conferences, lead discussions, and present case summaries as needed.
  • Prepare Executive Claims Summary for each case with timely reserve setting recommendations.
  • Review and manage pleadings, motions, briefs, and appellate papers to proactively defend and manage litigation.

Requirements

  • Admission to the NYS Bar with at least 12 years of experience in broad-based medical malpractice, including insurance law and coverage issues.
  • Significant direct negotiation skills and aptitude.
  • Proven management experience at partner level and claims experience preferred.
  • Effective oral and written communication skills with the ability to present case reviews and recommendations.
