About the position

The Office of Professional and Occupational Regulation is seeking a Staff Attorney to provide legal support and guidance on various regulatory matters related to professional licensing in Maine. This role involves managing agency rulemaking activities, offering legal advice, and assisting with consumer complaint resolutions, among other responsibilities. The attorney will work closely with agency staff to ensure compliance with state laws and regulations, contributing to the effective functioning of the regulatory agency.

Responsibilities

  • Manage the Office's agency rulemaking activities, including drafting and reviewing rules.
  • Provide legal advice to staff regarding professional licensing matters.
  • Interact with staff and consumers about the administrative complaint process.
  • Review and analyze case history, preparing complaint reports for licensing administrators.
  • Respond to staff requests for legal research and draft legal memoranda regarding statutory interpretation.
  • Coordinate Office responses to requests for records under Maine's Freedom of Access Act (FOAA).
  • Manage the agency's mandated reporting requirements, including to the National Practitioner Data Base and the ASC Registry.
  • Draft training materials for agency staff on rulemaking, document retention, complaint, and hearing procedures.
  • Draft and maintain the board member process manual.
  • Provide general legal guidance to the OPOR Director.

Requirements

  • Law degree from an accredited law school.
  • Admitted to practice law in Maine and currently registered with the Maine Board of Overseers of the Bar.
  • Knowledge of agency and industry laws, rules, policies, and procedures.
  • Understanding of the Maine law and judicial system.
  • Familiarity with the Maine Legislative Process.
  • Effective oral and written communication skills.
