About the position

As the Chief Legal Counsel for the Office of Inspector General (OIG) within the Minnesota Department of Education (MDE), you will play a pivotal role in supporting the statutory mandate to investigate fraud, waste, or abuse in MDE's public programs, as well as student maltreatment investigations. This position requires a seasoned attorney who can direct the activities of investigators, analysts, and other staff involved in these investigations. You will coordinate investigations with both internal and external partners, ensuring that all legal aspects are thoroughly addressed. In this capacity, you will act as the lead attorney for all OIG legal staff, providing expert legal guidance on issues related to fraud, waste, and abuse. Your responsibilities will include conducting independent investigations into Department programs, providing legal advice regarding civil, administrative, or criminal actions, and supporting law enforcement and prosecutors in pursuing criminal prosecutions. You will also be responsible for overseeing the OIG's disclosure and records management functions, as well as coordinating with the Attorney General's Office and the MDE General Counsel's office regarding litigation matters. Additionally, you will identify and review legislation, conduct bill analysis, and coordinate the implementation of new laws and rules. This role requires a strong commitment to fostering a diverse and inclusive workplace, as well as the ability to manage multiple complex projects simultaneously. Your expertise will be crucial in ensuring that the OIG operates effectively and in compliance with all legal standards.

Responsibilities

  • Direct the activities of investigators, analysts, and other staff on investigations.
  • Act as the lead attorney for all OIG legal staff.
  • Provide legal expertise on fraud, waste, and abuse investigations.
  • Support law enforcement and prosecutors in criminal prosecutions.
  • Provide legal advice related to civil, administrative, or criminal actions.
  • Coordinate and manage the OIG's legal advice.
  • Oversee the OIG's disclosure and records management functions.
  • Identify and review legislation and conduct bill analysis.

Requirements

  • Juris Doctorate (JD) degree from an ABA accredited law school.
  • Current license and in good standing to practice law in Minnesota, or ability to obtain within six months of hire.
  • At least four (4) years of experience as a practicing attorney in a law firm or public sector setting.
  • Demonstrated critical thinking and problem-solving skills.
  • Excellent verbal and written communication skills.
  • Knowledge of legal, ethical, and professional rules of conduct.
  • Experience with the Rules of Evidence, Criminal and/or Civil Procedure.
  • Litigation experience in criminal, civil, or administrative actions.

Nice-to-haves

  • Experience prosecuting or litigating financial crimes or actions.
  • Experience representing a state agency in administrative actions.
