About the position

Bellingham Technical College (BTC) invites applications for the position of Director of Compliance & Title IX Coordinator. This full-time professional exempt position is Fair Labor Standards Act (FLSA) exempt from overtime and is at-will. The Director of Compliance will be responsible for the development, implementation, operation, maintenance, and oversight of a college-wide compliance program to ensure the college's full adherence to legal, ethical, and regulatory obligations imposed by all levels of government and other oversight agencies, including the NWCCU (Northwest Commission on Colleges and Universities) accrediting body. The areas of focus include Title IX Compliance, the Violence Against Women Act (VAWA), Jeanne Clery Act Compliance, Mandatory Reporting of Child Abuse, Washington State Public Records and Records Management, Ethics and Conflicts of Interest, and collaborating on Safety and Risk Management. The Director's responsibilities will include implementing appropriate processes and procedures to ensure all aspects of college-wide compliance, including coordination of campus areas responsible for compliance, internal and public communications, working with affected departments and college administration to remediate compliance deficiencies, and evaluation of compliance risks. The Director is also responsible for promoting a college environment that supports observance of the highest ethical standards of conduct by those who work for the College or on its behalf. The Director will develop, coordinate, and participate in a multifaceted educational and training program that focuses on the elements of the compliance program, ensuring that all appropriate employees and management are knowledgeable of, and comply with, all applicable legal, ethical, and regulatory obligations. As the Title IX Coordinator, the Director will oversee the investigation and resolution of complaints, develop and conduct training designed to educate and support employees and students regarding their rights and responsibilities under Title IX, and serve as a resource for campus on matters related to all forms of discrimination, including sex-based harassment. The Title IX Coordinator will monitor the College's policy and procedures in relation to Title IX and ensure that the College meets all its obligations under Title IX of the Educational Amendments of 1972 and 34 C.F.R. Responsibilities

  • Coordinate/implement policies and procedures required for college compliance with public records requests, federal/state civil rights laws, Jeanne Clery Act, and Title IX laws and regulations for students, employees, and the public.
  • Develop and manage required programs and activities under the Jeanne Clery Act, and prepare, publish, and distribute the Annual Safety Report.
  • Coordinate all aspects of Institutional compliance with Title IX, including education, grievance procedures, prevention strategies, and remediation.
  • Lead and coordinate compliance-related investigations as needed, maintaining objectivity, and ensuring a fair and thorough process.
  • Manage the Title IX and EEO investigation and resolution process in compliance with College policy, ensuring the implementation of any resulting corrective measures through coordination with appropriate supervisors or departments; maintain intake, investigation, and outcome determination files in both hardcopy and electronic formats as appropriate under federal and state retention requirements.
  • Ensure a roster of trained and Title IX Investigator-certified Deputy Title IX Coordinators is maintained; oversee assignment of Deputy Title IX Coordinators.
  • Oversee prompt, effective, and equitable review of all reports related to discrimination, including sex-based discrimination; manage full oversight of initial follow up, intake interviews, investigation and resolution of complaints; monitor outcomes, track data related to trends and address any patterns; assess effects on the campus climate; develop regular reporting to college leadership.
  • Ensure the investigation process for any complaint received complies with employee collective bargaining agreements where applicable.
  • Provide training and development for the College community on awareness, intervention, and prevention of sex-based discrimination, sexual misconduct, relationship violence, and anti-discrimination efforts; monitor program effectiveness and coordinate any changes required for continuous improvement; maintain requisite records of all such training provided within the College.
  • Coordinate employee and student enrollment in required annual training, and any necessary follow-up with areas/supervisors to ensure completion, to ensure compliance with Title IX and anti-discrimination efforts.
  • Develop and disseminate educational materials (both print and online), that inform members of the College or campus community (employees, students, and parents/guardians) of their Title IX rights, responsibilities, and resources both within and outside of College premises.
  • Develop and execute a comprehensive compliance monitoring and auditing program; regularly assess the effectiveness of internal controls and identify areas for improvement.
  • Design, coordinate, and participate in educational and training programs to enhance awareness of compliance requirements and responsibilities.
  • Collaborate with the Administrative Team members, including the Director of Diversity, Equity, and Inclusion, to support the College bias incident protocols/processes to address hate crimes and incidents, conduct, behavioral concerns, employee relations, and Title IX developments; support efforts for campus understanding/awareness of identity, bias, and discrimination; represent Title IX and discrimination-prevention efforts within the College and community.
  • Coordinate the dissemination of information (both print and online) for public records request, the Title IX/EEO complaint process, and available resources.
  • Advise College leadership on public records requests, equal opportunity and Title IX issues and information in collaboration with HR and legal guidance, including with the College's Assistant Attorney General.
  • Maintain the Title IX/EEO and public records request database and websites, and the database used to track Title IX complaints.
  • Research and analyze complex policy issues, possible legal implications, and the impact of proposed policies and policy revisions on key areas of the institution; consult with subject-matter experts, as needed; ensure policies are published in a timely manner and in a format that is accessible, consistent, and compliant with public records requirements; maintain a schedule for the routine review and revision of existing policies.
  • Work closely with various college departments, including Human Resources, Business Office, Enrollment Services, Student Financial Resources, and Outreach, Advising, and Counseling, to ensure that compliance requirements are integrated into respective processes.
  • Stay current with developing legislation and regulatory issues that impact higher education by participation in professional communities, attending conferences, and membership/participation in local, regional, or national associations for Title IX.
  • Lead, work with, and serve on committees and councils as appropriate.
  • Keep current with laws, regulations, and technology that may affect position or assignments.
  • Manage allocated budget.
  • May supervise, assign schedules, evaluate, and train other staff.
  • Assist with other compliance duties as needed or assigned.

Requirements

  • Bachelor's degree from an accredited institution.
  • Minimum three years of recent experience in managing and leading compliance, audit, or enterprise risk management, or similar.
  • Experience investigating complaints within contractual/legal requirements.
  • Experience explaining complex compliance, legal or policy issues to any employee or supervisor.
  • Experience developing and leading training and education programs and assessing training effectiveness.
  • Demonstrated proficiency in the Microsoft Office Suite of programs.
  • Ability to demonstrate cultural competence (including an awareness and understanding of historically minoritized populations) that includes a commitment to work with others to create an educational and work environment that affirms commitment to equity, diversity, and inclusion.

Nice-to-haves

  • Salary range of $6,941 to $7,482 per month, depending on experience.
