About the position

The Enforcement Prosecutor Attorney II is responsible for performing moderately complex attorney work within the Texas Department of Licensing and Regulation (TDLR). This role involves enforcing statutes and rules, managing a high-volume caseload, and prosecuting violations in administrative proceedings. The attorney will work under the supervision of the Chief Prosecutor and will be involved in reviewing inspection reports, preparing legal documents, negotiating settlements, and overseeing legal assistants. The position is hybrid and located in Austin, TX.

Responsibilities

  • Manages a high-volume caseload that includes cases under multiple TDLR statutes.
  • Reviews inspection reports, investigation reports, and data reports from agency databases to determine violations, including indicators of human trafficking.
  • Researches and interprets statutes, rules, regulations, codes, and administrative records relevant to cases.
  • Prepares legal documents such as notices of alleged violation, motions, legal briefs, and case closing letters.
  • Decides the manner in which enforcement cases will be resolved and brings cases to final resolution.
  • Negotiates settlements of enforcement cases.
  • Represents TDLR in formal prosecution of enforcement cases in administrative hearings before SOAH.
  • Presents testimony and documentary evidence in accordance with Texas Rules of Evidence.
  • Prepares exceptions to Proposals for Decision and presents oral arguments on contested cases to the Commission.
  • Educates regulated industries and the public by making appearances and speaking about laws and agency policies.
  • Attends advisory board meetings and presents information about the Enforcement Division's activities.
  • Complies with division and agency training requirements and adheres to TDLR Personnel Policies.

Requirements

  • Graduation from an accredited law school with an L.L.B. or J.D. degree.
  • Member in good standing with the State Bar of Texas.
  • One (1) year of litigation experience preferred.
  • Experience with regulatory enforcement or criminal prosecution preferred.

Nice-to-haves

  • Knowledge of administrative law proceedings and concepts such as jurisdiction, notice, and due process.
  • Knowledge of the Administrative Procedures Act, Texas Rules of Evidence, and Civil Procedure.
  • Skill in using Microsoft Word, Excel, PowerPoint, and other applicable software.
  • Ability to interpret, apply, and explain statutes, rules, codes, and policies.
  • Excellent writing and communication skills.

Benefits

  • Full-time position with a salary range of $79,596 - $85,995 per year.
