About the position

Upstart is seeking a Senior Attorney to lead its consumer litigation team, overseeing all aspects of litigation related to its consumer lending products and services. The role involves managing a portfolio of consumer disputes, developing litigation strategies, and coordinating with various teams within Upstart to ensure compliance with laws and regulations. The ideal candidate will have extensive experience in consumer lending litigation and a strong ability to communicate and collaborate effectively.

Responsibilities

  • Manage a portfolio of 50+ consumer disputes involving consumer lending and servicing.
  • Drive case strategy for a full caseload, managing outside counsel as appropriate.
  • Manage an overall litigation budget for outside counsel fees and settlements.
  • Utilize tools to manage caseload, including reporting and status updates.
  • Engage with Upstart's product, business, legal, and compliance teams regarding products and features.
  • Assist attorneys with case management, including docketing deadlines and maintaining case files.
  • Recommend non-monetary settlement operational activities and identify root cause issues.
  • Manage collection, review, and synthesis of records from key stakeholders for litigation files.
  • Oversee responses to information requests and third-party subpoenas.
  • Review, summarize, and prepare legal documents, including responses to demand letters and settlement agreements.
  • Oversee compliance with settlement agreements and enforcement of judgments.
  • Assist with litigation activities, including tracking reporting and document management.
  • Maintain a Litigation Contact List with key stakeholders.
  • Work with other members of the Legal team and other company departments.
  • Design and implement systems and processes to increase efficiency.

Requirements

  • J.D. degree with superior academic credentials and state bar membership.
  • At least 7 years of experience in a top-tier law firm, in-house, or governmental agencies.
  • Experience in fintech, handling litigation matters in consumer lending.
  • In-depth knowledge of federal and state banking, lending, and consumer protection laws.
  • Strong communication skills with the ability to provide practical legal advice.
  • Self-starter mentality with the ability to work under pressure and limited direction.
  • Ability to prioritize and balance multiple tasks in a fast-paced environment.
