About the position

The Patent Attorney at the U.S. Environmental Protection Agency (EPA) serves as the legal authority on patents and intellectual property matters, providing national legal advice to various EPA offices. This role involves ensuring the legal rights of the Agency, inventors, and contractors are protected, and includes responsibilities such as working with the U.S. Patent and Trademark Office, advising on technology transfer agreements, and participating in litigation. The position requires strong analytical and communication skills, and a commitment to public service, while promoting diversity and inclusion within the workplace.

Responsibilities

  • Serve as the legal authority on EPA's patents and ensure legal positions/rights are clearly defined and protected.
  • Work with the US Patent and Trademark Office to maintain and prosecute patents.
  • Consult with scientists, laboratory directors, and contractors regarding potential patent awards.
  • Participate in preparation and presentation of cases before the Patent Trial Appeal Board (PTAB).
  • Coordinate with the Department of Justice in litigation of patent claims in federal court.
  • Counsel Agency clients on matters related to the Federal Technology Transfer Program.
  • Review technology transfer agreements such as Cooperative Research and Development Agreements (CRADAs) and license agreements.
  • Advise on other intellectual property matters and interpret intellectual property provisions in various Agency agreements.

Requirements

  • LL.M., LLB., or J.D. degree from an accredited law school.
  • Admitted to practice before the highest court of a State, U.S. territory, the District of Columbia, or the Commonwealth of Puerto Rico.
  • Registered to practice before the United States Patent and Trademark Office (USPTO).
  • Experience in providing legal advice and counsel at EPA, other federal, state or local agencies, or courts, non-governmental organizations, or in private practice.
  • Strong academic and employment record with evidence of nuanced legal analysis.
  • Excellent research and writing skills, superior oral and written communication, and strong interpersonal skills.

Nice-to-haves

  • Knowledge and relevant experience in administrative law, environmental law, information law, litigation, or a combination thereof.
