About the position

The Patent Attorney position at the Environmental Protection Agency (EPA) involves providing national legal advice on intellectual property matters, particularly patents, copyrights, and trademarks. The role requires working closely with various EPA offices and stakeholders to ensure the legal rights of the Agency and its inventors are protected. The attorney will also participate in litigation and advise on technology transfer agreements, contributing to the EPA's mission of protecting human health and the environment.

Responsibilities

  • Serve as the legal authority on EPA's patents and ensure legal rights are defined and protected.
  • Work with the US Patent and Trademark Office to maintain and prosecute patents.
  • Consult with scientists and contractors regarding potential patent awards.
  • Prepare and present cases before the Patent Trial Appeal Board (PTAB).
  • Coordinate with the Department of Justice in litigation of patent claims.
  • Counsel Agency clients on the Federal Technology Transfer Program and review technology transfer agreements.
  • Advise on various intellectual property matters and interpret provisions in Agency agreements.

Requirements

  • Must be a U.S. citizen.
  • Must have an LL.M., LLB., or J.D. degree from an accredited law school.
  • Must be registered to practice before the US Patent and Trademark Office.
  • Experience providing legal advice and counsel at EPA or similar organizations.
  • Strong academic and employment record with evidence of nuanced legal analysis.
  • Excellent research, writing, and communication skills.
