About the position

The Patent Attorney position at the Department of Defense involves providing expert legal advice on intellectual property matters, particularly in relation to government acquisitions and the Technology Transfer Act. The role requires the preparation and prosecution of patent applications, as well as defending claims against the government. The attorney will also conduct technical evaluations and represent the government in various legal proceedings.

Responsibilities

  • Provide advice on acquisition matters.
  • Provide legal opinions on complex and controversial problems concerning the utilization of intellectual property by the government.
  • Serve as a consultant for government management officials.
  • Defend claims against the Government, including licenses, administrative claims, and infringement suits.
  • Prepare, file, and prosecute patent applications in the United States and foreign countries.
  • Perform technical evaluations of inventions and conduct patentability searches and opinions.
  • Determine inventorship and conduct interviews with examiners of the USPTO.
  • Represent the Government before the examiners of the USPTO, the Board of Appeals, and the US courts.

Requirements

  • First professional law degree (LL.B. or J.D.) from an ABA-accredited law school.
  • Active membership in good standing of the bar of a State, territory, the District of Columbia, or the Commonwealth of Puerto Rico.
  • More than three years of professional legal experience after admission to the bar.
  • Completion of at least one year of service at a grade lower than the position to be filled for current Federal employees.
