About the position

EquipmentShare is looking for a business-focused attorney with experience in land use and commercial real estate transactions to join our team as a Real Estate & Land Use Counsel. This position is part of EquipmentShare's Legal Department, where you will collaborate closely with other attorneys and partner with the Real Estate, Construction, and various departments to support the Company's expansion real estate initiatives. The role is based in Columbia, Missouri, or can be remote for the right candidate. As a Real Estate & Land Use Counsel, you will lead the negotiation and drafting of EquipmentShare's real estate agreements and assist in closings for a variety of commercial transaction types, including purchases, sales, leases, sale-leasebacks, and acquisitions. You will also be responsible for the procurement of zoning and land use entitlements and permits. Your expertise will provide critical advice and counsel related to real estate site selection, transaction structure, due diligence (including zoning, survey, environmental review, and title), and real estate documents related to new branch opening activities. In this role, you will interact directly with colleagues at all levels within EquipmentShare's real estate, development, and construction teams, facilitating transparency across departments. You will also engage with outside counsel, opposing counsel, landlord personnel, title and escrow agents, and others. A key aspect of your responsibilities will be to understand, manage, and improve EquipmentShare and Legal Department procedures and forms to create efficiencies and cost savings. Responsibilities

  • Lead negotiation and drafting of EquipmentShare's real estate agreements.
  • Assist in closings for a variety of commercial transaction types, including purchases, sales, leases, sale-leasebacks, and acquisitions.
  • Procure zoning and land use entitlements and permits.
  • Provide advice and counsel related to real estate site selection, transaction structure, due diligence, and real estate documents for new branch openings.

Requirements

  • J.D./L.L.B. from an accredited law school.
  • Attorney license in good standing and admission to the bar in at least one state.
  • 5+ years of relevant substantive legal experience in a law firm or company legal department working on land use and commercial real estate transactions.
  • Experience with environmental law and land use issues and trends, preferably representing applicants before planning and zoning boards and other governmental agencies.
  • Ability to multi-task within a fast-paced work environment while maintaining a high degree of accuracy.
  • Proactive work ethic demonstrating initiative.
  • Strong organizational and time management skills, with the ability to prioritize projects and meet deadlines.
  • Strong computer skills, including the ability to learn and use proprietary computer systems and databases.
