About the position

The Senior Attorney will be assigned to the Conciliation Bureau within the office of Issue Resolution. The incumbent will be required to have extensive knowledge of the Medical Treatment Guidelines. Responsibilities include reviewing case files, preparing and issuing proposed decisions under WCL Section 25 and Section 23, and working directly with the Medical Director's Office on requests for review of Prior Authorizations Requests (PAR). The Senior Attorney will draft resolutions in proposed decisions following a standardized format within the parameters of the Workers' Compensation Law and the Medical Treatment Guidelines. They will also be responsible for resolving PARs and other issues, and will need to be familiar with HPA software, CPT, ICD-10 codes, and CARC/RARC codes. The role includes presiding at conciliation meetings and Pre Hearing Conferences, and may involve special legal projects, presentations, and Continuing Legal Education lectures.

Responsibilities

  • Review case files and prepare proposed decisions under WCL Section 25 and Section 23.
  • Work with the Medical Director's Office on Prior Authorization Requests (PAR).
  • Draft resolutions in proposed decisions following standardized formats.
  • Resolve PARs and other issues related to Workers' Compensation Law.
  • Conduct legal research and apply law to facts.
  • Prepare Amended Proposed Decisions upon receipt of objections.
  • Request hearings and list outstanding issues to be resolved.
  • Preside at conciliation meetings and Pre Hearing Conferences.
  • Engage in special legal projects and presentations.

Requirements

  • Must be reachable on the appropriate Civil Service eligible list.
  • Law school graduation and/or eligibility for NYS Bar Admission for Assistant Attorney 1.
  • Admission to NYS Bar for Assistant Attorney 2.
  • 12 months as an Assistant Attorney 2 or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience for Assistant Attorney 3.
  • 12 months as an Assistant Attorney 3 or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience for Senior Attorney.

Nice-to-haves

  • Experience with HPA software, CPT, ICD-10 codes, and CARC/RARC codes.
  • Familiarity with the Medical Treatment Guidelines.
