About the position

RWE Offshore Wind Services, LLC is seeking an experienced and motivated Legal Counsel/Assistant General Counsel to support its rapidly growing U.S. Offshore Wind business. This position will be based in Boston, MA, and is part of the global Regulatory Law team. The successful candidate will work closely with a small team of approximately 5-7 other lawyers and paralegals, providing legal support for regulatory, corporate, transactional, and procurement matters. The role requires collaboration with various departments to ensure comprehensive legal support for the U.S. Offshore Wind business. In this role, you will be responsible for providing legal support related to RWE's participation in federally administered offshore wind lease auctions and state-administered offtake solicitations. This includes drafting and reviewing solicitation bid materials and responses to requests for information following bid submission. You will also advise on the legal implications and feasibility of different offtake structures, such as Power Purchase Agreements (PPA) and Offshore Renewable Energy Certificates (OREC), while coordinating with Government Relations teams on communications with state agencies and policymakers. Additionally, you will assist in the preparation and review of formal filings and public comments in transmission planning efforts led by state public utility commissions or Regional Transmission Organizations (RTOs). Your role will involve participating in the formation of permitting strategies and advising the development team on federal and state permitting processes, including those under the Outer Continental Shelf Lands Act, National Environmental Policy Act, Coastal Zone Management Act, Marine Mammals Protection Act, New York Article VII, and California Environmental Quality Act. As the first point of contact for assigned projects within the legal team, you will work closely with various internal teams, including Development, Finance, Partnering, External Relations, Credit Risk, Tax, and Permitting, to provide legal advice and coordinate specialized in-house and external legal counsel efficiently. You will oversee all legal matters related to assigned projects and advise senior management on legal risks, including claims and disputes. The position also involves driving standardization and process improvement initiatives within the U.S. Offshore Wind team and the larger global Legal team, as well as developing customized solutions for complex project challenges.

Responsibilities

  • Provide legal support for RWE's participation in offshore wind lease auctions and state offtake solicitations.

  • Provide legal support in relation to administrative appeals.
  • Drive standardization and process improvement initiatives within the US Offshore Wind team.

Requirements

  • Qualified as a lawyer in the US, preferably in New York, Massachusetts, or California.
  • At least 5 years of work experience as a lawyer in a recognized law firm or as in-house counsel in the energy sector or complex international infrastructure projects.
  • Significant expertise in complex regulatory matters, particularly with FERC, state public utility commissions, BOEM, NOAA, EPA, or state environmental permitting agencies.
  • Experience with large-scale infrastructure projects, especially in renewables and offshore wind, is desirable but not mandatory.
  • Demonstrated ability to interact with regulatory officials and achieve desired outcomes collaboratively.
  • Comprehensive understanding of administrative law principles and core federal laws relevant to RWE's US Offshore Wind business.
